How AI is used
From the verdict, the plea and the sentencing remarks the lawyer supplies, build a table with the date, the court, the offence as charged, the plea, and the page of each extract. Add a row for any personal-injury compensation order, separate from any property order. Do not write a narrative and do not prepare anything that is filed.
What the lawyer must review
  • Check each row against the page named before it is used in the civil claim
  • Do not treat a conviction or a plea as the civil pleading.
  • Keep a personal-injury compensation order separate from a property order
  • Use a firm-controlled tool for health records. ASCR r 9, APP 11 and the Privacy Act 1988 (Cth) apply.

The work product

Forum. Queensland sentencing court, and a civil assault claim that may use the criminal record

Produce. A page-referenced table of the verdict, the plea, the remarks and any s 35 order.

Have ready. Verdict, plea and sentencing remarks; Any compensation or restitution order; Section 35.

Example of the limit. Illustrative example: The order contains a personal-injury amount and a separate amount for damaged property. The table puts them in different rows. It does not describe either row as the civil claim.

Stop and hand it back when

  • The remarks are incomplete, so a page cannot be cited.
  • The order does not say whether the amount is injury or property.

Checklist

  1. Index the court, the date, the offence as charged, and the plea.
  2. Section 35(1)(c) lets the court order compensation for personal injury suffered because of the offence, whether or not that person is the victim of the offence. Subsections (1)(a) and (1)(b) deal with restitution and compensation for property.
  3. An order under s 35 may be in addition to any other sentence. If an offence is taken into account under s 189, subsection (3) also allows an order under subsection (1).
  4. The section does not say the order is the civil cause of action. Do not treat the index as a pleading.

Sources

Sentencing remarks often contain health information. Keep them in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

Nothing in this index is filed.

A later question of whether the order reduces civil damages is a separate task. The court-ordered payments page does not answer it.
