How AI is used
From the verdict, the plea and the sentencing remarks the lawyer supplies, build a table with the date, the court, the offence as charged, the plea, and the page of each extract. Add a row for any compensation order and its components. Do not write a narrative and do not prepare anything that is filed.
What the lawyer must review
  • Check each row against the page named before it is used in the civil claim
  • Do not treat a conviction or a plea as the civil pleading.
  • Index a compensation order's components in their own rows
  • Use a firm-controlled tool for health records. ASCR r 9, APP 11 and the Privacy Act 1988 (Cth) apply.

The work product

Forum. Victorian sentencing court, and a civil assault claim that may use the criminal record

Produce. A page-referenced table of the verdict, the plea, the remarks and any s 85B order.

Have ready. Verdict, plea and sentencing remarks; Any compensation order; Section 85B.

Example of the limit. Illustrative example: The remarks include a compensation order for counselling and a separate amount for a damaged phone. The table puts the counselling amount in a personal-injury row and the phone in a property row. It does not drop the property amount into the injury column.

Stop and hand it back when

  • The remarks are incomplete, so a page cannot be cited.
  • The order's components are not separated.

Checklist

  1. Index the court, the date, the offence as charged, the plea, and whether the court found the person guilty or convicted them.
  2. Section 85B lets the court, on the application of a person who suffered injury as a direct result, order compensation for pain and suffering, reasonable counselling and medical expenses, and other expenses actually and reasonably incurred or reasonably likely. It excludes loss of or damage to property.
  3. The court may allow instalments. If the order is on the file, give each component its own row, and record whether the section's property exclusion is engaged.
  4. The section does not say the order is the civil cause of action. If the lawyer has marked an intentional assault, this index is not a damages calculation under a Part that s 28C or s 28LC takes away.

Sources

Sentencing remarks often contain health information. Keep them in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

Nothing in this index is filed. The lawyer decides what, if anything, is later used.

The section does not say a later civil claim is reduced by the order. That question is a separate task.
