Build the particulars table for a New South Wales personal injury pleading

How AI is used
Turn the lawyer's chronology into a particulars table with a source for each row, and list the gaps. Do not write the pleading, and do not generate the content of a person's evidence.
What the lawyer must review
  • The lawyer writes the pleading and checks every particular against a source
  • Verify every citation yourself. Practice Note SC Gen 23 does not let the tool verify them
  • Check whether the District Court or the Local Court has adopted that practice note
  • Check which scheme notice applies. There is no single pre-court notice for every injury

The work product

Forum. A New South Wales personal injury proceeding in the Supreme Court, the District Court or the Local Court, or a claim that may become one

Produce. A particulars table and a gap list. Not the statement of claim.

Have ready. The chronology the lawyer has accepted; The source document and page for each fact; The scheme, if the lawyer has identified one.

Example of the limit. Illustrative example: The chronology has a wage figure with no payslip. The table leaves that row blank and adds it to the gap list. It does not become a paragraph of the statement of claim.

Stop and hand it back when

  • The output is being pasted into the pleading or into a person's evidence.
  • A time limit would be stated for a scheme the lawyer has not identified.

Checklist

  1. Each row has a document, a page and a date. A gap is listed and is not filled.
  2. Practice Note SC Gen 23 paragraph 9B allows a chronology. Paragraphs 16 to 18 require the author to verify that citations exist, are accurate and are relevant, and to verify references to evidence. That verification must not be done only by the tool.
  3. A motor accident damages claim is a separate notice under section 6.12. Section 6.14(2) requires it within 3 years after the accident, unless the regulations change that period. The regulations were not opened.
  4. A statutory-benefits notice is a different notice. Section 6.12(4) requires the two notices to be given separately, and section 6.13 sets the statutory-benefits times. Do not treat one notice as the other.
  5. Do not put the table into a statement of a person's evidence. Paragraph 10 of Practice Note SC Gen 23 prohibits generating that content. PIC13 paragraph 12 is to the same effect in the Commission.
