From the receipt date the lawyer confirms, list each day-count in sections 37A, 39 and 41 and the calendar date it produces. Flag a step the section does not state as a day count.
What the lawyer must review
  • You decide which receipt date starts each clock.
  • The offer under section 41(2) is as soon as practicable. Do not turn that into a day count.
  • A diary date is a prompt. It is not advice that the claim is in time.
  • Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach.
