How AI is used
From the notice and the date it was given or received, list only the response times the opened guidelines and section 7.9 state for that kind of notice, and the day each falls due. Do not decide that a step is out of time.
What the lawyer must review
  • Decide which clock applies to this notice.
  • A claim-time rule and an internal-review rule are not the same clock.
  • Count from the date the page uses, and show the last day.
  • Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test.

The work product

Forum. Motor Accident Injuries Act 2017 (NSW) and the Motor Accident Guidelines, for an accident on or after 1 December 2017

Produce. A diary of the clocks that match the notice. No decision that a step is out of time.

Have ready. The notice and its date; Whether it is a claim, a liability decision or an internal-review request; Accident date.

Example of the limit. Illustrative example: A liability decision is received on 2 March. The tool diaries 28 days to request an internal review and, once a request is received, 14 days to notify the result, or 21 days where guideline 7.25 applies, and not more than 28 days after the request. It does not call the claim out of time.

Stop and hand it back when

  • The accident is before 1 December 2017 and Part 7 has been applied.
  • The kind of notice has not been identified.

Checklist

  1. Guidelines clause 4.15: weekly payments from the day after the accident require a statutory-benefits claim within 28 days. Clause 4.16 is the same 28 days where the claim is made on the Nominal Defendant.
  2. The insurer must start weekly payments as soon as possible and within 10 business days after it accepts liability. Clause 4.44 states that.
  3. A claimant may request an internal review within 28 days of receiving the decision. A later request may be accepted or declined. A decline must say the claimant may go to the Personal Injury Commission.
  4. Section 7.9(4) requires the insurer to notify the result within 14 days after receiving the request. Guideline 7.25 extends that to 21 days for permanent impairment, a threshold injury, fault, mostly at fault, a serious driving offence, or contributory negligence, and to 14 days after new information. The maximum is 28 days after the request. Section 7.9(7) says the review does not stay the decision.
