The work product

Forum. Victoria. Transport Accident Commission claim decisions and the Common Law Protocol 2026.

Produce. A diary of response dates from the confirmed receipt date, with gaps marked.

Have ready. Confirmed receipt date; Type of application; Whether the required information has been received; Whether the accident was in the course of employment.

Example of the limit. Illustrative example: A serious-injury form was received on a confirmed date, but the required medical attachments are still missing. The diary records the 14-day acknowledgement and leaves the 45-day period blank until that information is received.

Stop and hand it back when

  • The receipt date is not confirmed.
  • A serious-injury period has been entered on a compensation claim.

Checklist

  1. For a compensation claim, diary 21 days for a decision to accept or deny, or a request for further information. Do not use that period for a serious-injury application.
  2. Within 14 days of a serious-injury application the Commission acknowledges receipt. The chapter 6 periods do not start until all required information has been received.
  3. Within 45 days of a genuine application the Commission provides a certificate, notice of an intended denial, contact to arrange a serious-injury conference, or a request for more information or an examination.
  4. Within 21 days of an information request the lawyer confirms the information has been sought, provides an authority, or explains why the request is unnecessary. Once the lawyer says the request is fully answered, the protocol requires the Commission to act within 28 days of that notice or the examination report, whichever is later.

Sources

For an accident in the course of employment, the Commission advises within 28 days whether it accepts that the injuries arose from a transport accident. If that decision is not made within 90 days, the lawyer may use chapter 9 of the framework agreement. Chapter 6 does not start until the 28-day decision is communicated.

Applications lodged before 30 March 2026 use the 2016 protocols. Do not diary the 2026 periods for those applications.
