The work product

Forum. Victoria. Use records matched to a Senior Practitioner authorisation under the Disability Act 2006.

Produce. A match of each use to an authorisation, and a list of uses with no match.

Have ready. Use records; Authorisations; Reports the lawyer has selected.

Example of the limit. Illustrative example: Three use entries are matched to an authorisation for the same person and period. A fourth entry has no authorisation. It is listed and not classified. The lawyer decides what the list means.

Stop and hand it back when

  • The use record does not identify the person or the practice.
  • The tool has labelled an unmatched use as a reportable incident.

LawyerSet the scope, supervise the work closely, verify every part relied on, resolve omissions and exceptions, and approve the exact output.

Checklist

  1. An authorisation relied on for a registered NDIS provider is a written order of the Senior Practitioner under section 27(2)(g), or the approval the Senior Practitioner's page describes for that practice.
  2. Do not match seclusion, mechanical restraint or physical restraint to an authorisation that the record limits to chemical or environmental restraint.
  3. For an NDIS behaviour support plan, the Senior Practitioner authorises the regulated restrictive practice. The state-funded path, where an authorised program officer lodges the plan, is a different path.
  4. List a use that has no matching authorisation. Do not classify it as lawful or as a reportable incident.

Sources

Section 27(5) requires written advice to the person or NDIS participant of an authorisation as soon as practicable. The directions sections cited on the Senior Practitioner page were not opened.

The tool writes nothing on a report to the Commission or to the Senior Practitioner.
