How AI is used
Mark whether the draft already names a qualified individual, physical and access controls, a cybersecurity provision, training and unannounced drills, an update at least every five years, and resubmission for a change that may substantially affect security. Write no new plan sentence and do not say the plan will be approved.
What the lawyer must review
46 USC section 70103(c) requires an owner or operator of a vessel or facility described in paragraph (2) to submit a security plan. Paragraph (2) covers vessels and facilities the Secretary believes may be involved in a transportation security incident, and it excludes Department of Defense vessels and facilities. You decide whether this vessel or facility is in that class. Paragraph (3) requires the plan to be consistent with the national and area plans, to identify the qualified individual, to include physical, passenger, cargo, and personnel security, access control, procedural policies, communications, cybersecurity risks that may cause a transportation security incident, and other security systems, to identify security measures, to describe training, periodic unannounced drills, and security actions, to provide a strategy and timeline for that training and those drills, to be updated at least every five years, and to be resubmitted for approval of each change that may substantially affect security. A facility plan is also resubmitted for a change in ownership or operator that may substantially affect security. The Secretary reviews, may require amendments, and approves a plan that meets the subsection. Part 104 of title 33 of the CFR was not opened. The tool does not write the plan and does not predict approval. Opinion 512.
