- How AI is used
- Pull from the bill the carrier, the shipper, the goods description, any declared value, the port of discharge, and any clause that names a package limitation or a suit deadline. Do not say whether the clause wins.
- What the lawyer must review
- The COGSA note to 46 USC section 30701 applies to contracts of carriage covered by a bill of lading or similar document of title. It limits liability to 500 dollars per package, or per customary freight unit if the goods are not shipped in packages, unless the shipper declared a higher value and it was inserted in the bill. Notice of loss must be given in writing before or at removal of the goods, or within three days of delivery if the loss is not apparent. Removal without that notice is prima facie evidence of delivery as described. The carrier and the ship are discharged unless suit is brought within one year after delivery or the date the goods should have been delivered. Failure to give notice does not, by itself, take away that one-year suit. The Act does not apply to charter parties except as to bills issued under them. District courts have admiralty jurisdiction under 28 USC section 1333. You check every extracted figure against the bill and the note. Opinion 512 applies.
