- How AI is used
- From the citation and the penalty notice, list each cited item, the date the employer received the notice of proposed penalty, and the date 15 working days after that receipt using the dates the lawyer supplies. Do not write the notice of contest.
- What the lawyer must review
- An employer who has received a citation or a notice of proposed penalty may notify the Area Director in writing of an intention to contest the citation or the proposed penalty before the Occupational Safety and Health Review Commission. The notice must be postmarked within 15 working days of the employer's receipt of the notice of proposed penalty, and it must say whether it is directed to the citation, the proposed penalty, or both (29 C.F.R. § 1903.17(a)). The Area Director transmits it to the Commission. An employee contest of the abatement period is paragraph (b), also 15 working days from receipt of the penalty notice or of notice that no penalty is proposed. You decide whether to contest, and you write the notice. A State-plan contest rule was not opened.
