Draft a collective-bargaining proposal from the employer's instructions
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Draft the proposal from the wages, hours and other terms the lawyer marks as open, with a square-bracket gap for any term not marked. Do not state that the other side must accept it.
- What the lawyer must review
- 29 U.S.C. § 158(a)(5): it is an unfair labor practice for an employer to refuse to bargain collectively with the representatives of the employees, subject to § 159(a). Section 158(d): to bargain collectively is the mutual obligation to meet at reasonable times and confer in good faith with respect to wages, hours, and other terms and conditions of employment, or the negotiation of an agreement, or any question arising under it, and to execute a written contract incorporating any agreement reached if either party asks. The obligation does not compel either party to agree to a proposal or require a concession. The section goes on to conditions for terminating or modifying a contract. You open those conditions, and you open § 159(a), before you describe who must be bargained with or how a contract is ended. You check every line of the proposal. It is not a demand that the representative concede.
