From the order, the case plan goal and the dates already on the file, list the date 30 days after the child entered care or an interim order was made, and, where the goal is restoration, the date 30 days after the goal changed to assess restoration and each date 90 days after the family action plan. List the next annual care-plan review, the next 12-month cultural support plan review where the child is Aboriginal or culturally and linguistically diverse, and the health plan review at six months where the child is under five or at 12 months where the child is over five. Do not write the plan.
What the lawyer must review
The lawyer settles the plan and the review dates. The NSW Department of Communities and Justice permanency case-planning page states that an out-of-home care case plan is developed within 30 days of the child entering care and an interim order being made, and is reviewed at least annually and when there is a significant change in the placement or other circumstances. A family action plan is developed within 30 days of an interim order for preservation or restoration. Where the goal is restoration, the page states that the plan is developed within 30 days of the interim order or within 30 days of the goal changing to assess restoration, and is reviewed every 90 days. A cultural support plan for an Aboriginal child or a culturally and linguistically diverse child is formally reviewed at least every 12 months. The page states that a health management plan is reviewed every six months for a child under five and annually for a child over five, and that a personalised learning and support plan has a minimum review of once a year, with a recommendation of once a semester. Development and review are reported through ChildStory Partner. The page states that the Department develops a summary of proposed plan and files it within two weeks of the first court mention. The page refers to sections 9, 10, 11 and 12 of the Children and Young Persons (Care and Protection) Act 1998 on participation. The separate timeframes list linked from the page was not opened, so a period that this page does not state is not added. A leaving-care plan is a separate task. The tool's date list is not the plan.

Checklist

  1. Count 30 days from entry to care or the interim order, and 90 days only where the goal is restoration.
  2. Set the health-plan review at six months for a child under five and at 12 months for a child over five, as the page states.
  3. Confirm the plan itself is the lawyer's, and that a leaving-care plan is not reviewed under this task.
