Record the child's expressed views for the court
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- The child's words do not go into a tool. From the document index the lawyer has cleared, list every occasion on which the child's views were recorded, with the date, who took them and the page, so the lawyer can see where the record is second-hand, stale or missing.
- What the lawyer must review
- The lawyer takes the child's views directly or confirms how they were taken, and puts them to the court in the child's words without editing, interpreting or completing them.

Who does what
| Role | What they do |
|---|---|
| Assistance | Supporting preparation only. The child's words do not go into a tool. From the document index the lawyer has cleared, list every occasion on which the child's views were recorded, with the date, who took them and the page, so the lawyer can see where the record is second-hand, stale or missing. The tool writes nothing into the document. Substantive advice, judgement and any restricted content remain with the responsible human. |
| Lawyer | Perform the substantive analysis and decisions. Independently check any permitted supporting work and approve the exact output for its intended use. |
Checklist
- Confirm how the child's views are to reach the court in this jurisdiction — directly, through the child's legal representative, or through a report — and on what basis the child is represented.
- Check each recorded view against the date it was taken and the child's age and circumstances at that date, and mark views older than a few months as stale.
- Distinguish the child's own words from a worker's, carer's or assessor's characterisation of them, and note where only the characterisation exists.
- Confirm the child has been told what will happen to their views and who will read them, and record anything the child asks not be repeated.
- Keep the child's disclosures, the child's name and the placement details out of every tool and out of any working note that is shared outside the firm.
