Child Protection & Care Proceedings
Name the applicant and the Act first — The applicant is a state or territory department head and the power comes from that jurisdiction's child-protection statute, so order names, durations, forms and the standard of the court's satisfaction change at every border. Confirm which Act, which court division and which version of the Act applies to this child before any template, precedent or prompt from another state is used. Keep the child's words the child's — A child's expressed views are that child's own evidence and must reach the court in the child's own terms. Never let a tool draft, complete, smooth or paraphrase a child's views, and keep the child's disclosures out of any tool that has not been cleared for them. Treat the departmental record as restricted, not merely confidential — Case notes, notification histories, health and police material, carer identities and placement addresses carry statutory non-disclosure restrictions and real safety consequences. Establish the permitted purpose and the platform's confidentiality position before any of it is processed, and keep placement addresses and carer identities out entirely. Test the plan; do not summarise it — A care plan or case plan is a statutory document about which the court must be satisfied. Use AI to line the plan up against the record and the statutory requirements, then decide for yourself whether restoration was properly assessed, whether the services were really offered and available, and whether the placement principles were applied in substance.

Tasks

| Task | How AI is used | Human involvement | What the lawyer must review |
|---|---|---|---|
| Build the departmental-records chronology for a care matter | From the departmental records the lawyer has selected and cleared for processing — case notes, notification and risk-report summaries, prior assessments and file correspondence — extract each dated entry into a chronology table giving the date, the document, the page, who recorded it, and whether the entry records what the worker saw or what the worker was told. | YellowClose supervision | The lawyer confirms the record set is the complete cleared holding and checks that no allegation has been carried into the chronology as an established fact. |
| Test the department's grounds and particulars against its own record | Working from the application, the grounds and particulars, the caseworker's affidavit and the chronology the lawyer has settled, assemble under the lawyer's direction a table lining each pleaded ground up against the record entries cited for it, and list every assertion for which no source appears in the record. | YellowClose supervision | The lawyer decides what is in issue, what is conceded and what is contested, and checks every row to its source page before the table drives a position at the first mention or at establishment. |
| Prepare the parent's or carer's affidavit in the care proceedings | The tool writes nothing into the affidavit. It indexes the exhibits and annexures, compares the lawyer's draft against the proofing note and the source documents to list every fact with no source and every source not yet deposed to, and checks the document's form against the court's requirements. | RedLawyer-led | The lawyer takes the evidence, drafts it in the deponent's words, and confirms the deponent has read and adopted every paragraph before it is sworn. |
| Record the child's expressed views for the court | The child's words do not go into a tool. From the document index the lawyer has cleared, list every occasion on which the child's views were recorded, with the date, who took them and the page, so the lawyer can see where the record is second-hand, stale or missing. | RedLawyer-led | The lawyer takes the child's views directly or confirms how they were taken, and puts them to the court in the child's words without editing, interpreting or completing them. |
| Test the care plan or case plan against the statutory requirements | Line the filed care plan or case plan up against the statutory requirements the lawyer has set out and against the chronology and service records, and assemble a table showing, requirement by requirement, what the plan asserts, where it appears and what the record supports. | GreenLawyer review | The lawyer forms the view on restoration, on the adequacy of what was offered and on the placement, and checks each asserted service against the record before any objection is put. |
| Build the placement and order timeline against the statutory reunification clock | From the sealed orders, placement records and court dates the lawyer has supplied, compute a timeline of each placement and order period, the cumulative time in out-of-home care and the date each statutory or order deadline falls, against the jurisdiction rule set the lawyer has set up and validated. | YellowClose supervision | The lawyer confirms the rule set is the law in force for this child on the relevant dates and checks each computed date against the sealed orders. |
| Reconcile the contact record against the contact order or plan | From the department's contact records, the carer's records and the client's own diary, build a log of each scheduled occasion against what the order or plan requires, marking each as occurred, shortened, cancelled by the department, cancelled by the carer or cancelled by the parent, with the reason recorded and the source cited. | GreenLawyer review | The lawyer checks the log against the operative order and resolves each discrepancy with the client before it is used in a submission or put to a witness. |
| Settle the assessment questions and test the assessor's report against the record | Assemble the document schedule and, under the lawyer's direction, work up the question set from the issues table; then compare the report against the documents it cites and against the chronology, and list each conclusion whose stated factual basis does not appear in the record. | RedLawyer-led | The lawyer settles every question put and decides what the report's reliance on the department's account means for weight and for cross-examination. |
| Build the kinship and placement options table against the placement principles | From the family and kin information the client and the department have provided and from the carer assessment records, assemble a table of each placement option with its relationship, assessment status, the sibling and schooling consequence and the gaps in what has been assessed, against the statutory hierarchy the lawyer has set out. | YellowClose supervision | The lawyer decides what the placement principles require on these facts and whether cultural connection and the Aboriginal and Torres Strait Islander Child Placement Principle have been addressed in substance rather than recorded as met. |
| Prepare the pack to vary or rescind the care orders, or to seek review of the case plan | From the sealed orders, the chronology since they were made and the client's completed-services records, draft the application or review request and the change-of-circumstances schedule under the lawyer's direction, and index the supporting material. The tool writes nothing into the supporting affidavit. | YellowClose supervision | The lawyer decides whether the leave or review threshold is met on these facts and which forum the complaint belongs in, and checks every asserted change against its evidence. |
| Prepare a care-proceedings affidavit outline in NSW Children's Court | Organise instructions into headings only; lawyer drafts the affidavit text. | RedLawyer-led | Children's Court NSW PN 21 adopts SC Gen 23: Gen AI must not generate affidavit content. |
