Where this comes from
The official form is published by fwc.gov.au; this page is a completion guide. Last checked on 2026-10-18.
When to use it
Use when acting for a current or prospective employee or worker who has not been dismissed but believes adverse action was taken against them for a prohibited reason under the general protections in the Fair Work Act 2009 (s 372). For a dismissal, use Form F8.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may build the chronology of the adverse action and check the application covers what the Commission asks for; the lawyer decides the prohibited reason and checks every statement in each application, and the Commission's GenAI disclosure and checking statement are made.
AI may
- Build a dated chronology linking the workplace right, attribute or activity to each adverse action, with sources
- Look up the respondent's ABN from the payslip or the ABN register and check it against the draft
- Check the draft covers every item the Commission lists, including the harm suffered and the outcome sought
AI must not
- Must not decide whether the action was adverse action or what the prohibited reason was
- Must not write the worker's account in their words or invent detail
- Must not cite a case that has not been checked and hyperlinked
The lawyer checks
- The worker has not been dismissed (otherwise Form F8 and its 21-day limit apply)
- No current case about the same issue with another body under an anti-discrimination law
- Within six years of the incident
- Respondent correctly identified, with ABN
- Fee paid or waiver sought on Form F80; GenAI question answered and the checking statement included if GenAI was used
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
