When to use it
Use when acting for a worker in a constitutionally covered business who has been bullied more than once at work, expects it to continue, and the behaviour creates a risk to their health and safety.
How AI may be used
AI may organise incidents into a dated table and check the application covers what the Commission asks for; the lawyer checks every statement in each application, and the worker's account stays in the worker's words.
AI may
- Organise the worker's records of incidents into a dated table with sources (emails, messages, file notes)
- Check the draft application covers every item the Commission lists, including at least two examples and the health and safety risk
AI must not
- Must not write or embellish the worker's account of the behaviour
- Must not characterise conduct as bullying for the worker; that is the worker's claim and the lawyer's advice
The lawyer checks
- Worker in a constitutionally-covered business; bullied more than once; risk that it will continue; risk to health and safety
- At least two examples, with dates, of the behaviour
- Client understands the employer or principal and each person named will receive the application and documents
- Any performance management or disciplinary action disclosed
- GenAI question answered and the checking statement included if GenAI was used
