List whether the lawyer's instructions say a workers' compensation or other periodic disability claim has been filed or is intended. Do not write the statement.
What the lawyer must review
42 U.S.C. § 424a(e) says that if it appears the person may be eligible for a periodic benefit that would cause a reduction under that section, the Commissioner may require, as a condition of certifying payment of benefits under §§ 423 and 402, that the person certify whether they have filed or intend to file such a claim. 20 C.F.R. § 404.408 states when the reduction is required and when it is not. The regulation page opened here does not restate the certification sentence. Use the statute for that condition. This is not a notice to the compensation payer before the compensation is paid.
