Advise whether to ask Social Security to waive an overpayment
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- Extract from the notice the amount, the reason and the date, and list what the file shows about ability to repay. Write no advice and no waiver request.
- What the lawyer must review
- The Social Security Administration says that a person who cannot afford repayment and feels the error was not their fault, or is unfair, can ask for a waiver so the overpayment need not be repaid. You decide whether to ask, and you write the request and the advice. You do not treat a generated paragraph as the client's account of fault or finances. If the client instead disputes the amount, the Administration says to appeal, not to use the waiver path.
