- Social Security has four appeal steps: reconsideration, a hearing, Appeals Council review, and a federal district court action. A request for reconsideration must be filed in writing within 60 days after the date the person receives notice of the initial determination, unless the period is extended for good cause under 20 C.F.R. § 404.911. Judicial review under 42 U.S.C. § 405(g) is a civil action commenced within 60 days after the mailing of the notice, or any further time the Commissioner allows. A VA Board Appeal is requested within 1 year of the date on the decision letter for an initial claim, a Supplemental Claim or a Higher-Level Review, and within 60 days for a contested claim. You check every date against the letter before anyone relies on the register.
