Rebuild a Social Security overpayment from the notice and the payment records
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Rebuild the overpayment month by month from the notice and the payment and income records, and flag any month the records do not explain.
- What the lawyer must review
- The Social Security Administration describes an overpayment as receiving more money than the person should have, and says the notice explains the reason. If the person disagrees with the amount, or believes there was no overpayment, the Administration says to appeal, and that an appeal is for a disagreement with the amount. The Administration waits at least 30 days after the notice before collecting, and if a waiver or an appeal is asked for within 30 days it will not collect until it decides the request. If there is no repayment within 30 days it withholds 50 percent of the benefit, or 10 percent of an SSI payment, each month. You check every month against the notice and the records before an appeal is filed.
