Set out the detriment claimed as future loss from a personal injury
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the earnings and capacity material the lawyer supplies, list each claimed head of future loss and the fact in the file that is said to support it. Do not choose a percentage and do not calculate an award.
- What the lawyer must review
- California Civil Code § 3333 measures damages for breach of a non-contractual obligation, except where the Code expressly provides otherwise, as the amount which will compensate for all the detriment proximately caused, whether it could have been anticipated or not. Section 1714(a) is the ordinary-care liability section that can make the obligation arise. The opened text of § 3333 does not require a stated percentage possibility or a most-likely-future-circumstances finding. You decide what future loss the evidence supports and you write the schedule. Do not import Civil Liability Act 2002 (NSW) s 13.
