Check an expert report's assumptions against the records
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List each assumption the report states and the record page, if any, that contains the same fact. Mark an assumption with no page. Do not rewrite the opinion.
- What the lawyer must review
- Federal Rule of Evidence 702 admits an opinion only if the proponent shows it is more likely than not that the testimony meets the rule, including that the opinion reflects a reliable application of the principles and methods to the facts. Formal Opinion 512 requires review of tool output, and of citations, before a court submission. You decide whether the assumption is fair and whether the opinion meets Rule 702.
