- Federal Rule of Evidence 702 requires a reliable application of the principles and methods to the facts. The referral is what sets those facts. You write it and you decide whether to send it. 45 C.F.R. § 164.502(a) limits use and disclosure of protected health information by a covered entity or a business associate. Not every firm is one. Model Rule 1.6 still keeps the records out of a public tool.
