From the reports the lawyer selects, index one paginated bundle and list only the medical questions the lawyer has written. Do not write the application that is lodged.
What the lawyer must review
  • Decide the questions, and which Commission application can ask them.
  • For lump sum permanent impairment, only the worker or their representative applies.
  • Do not write the lodged application. The tool writes the index and the question list.
  • Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test.

The work product

Forum. Personal Injury Commission medical disputes pathway

Produce. An index of one bundle and the questions the lawyer has written. No lodged application.

Have ready. Reports the lawyer selects; Questions the lawyer has written; Which dispute the lawyer says is being lodged.

Example of the limit. Illustrative example: The lawyer has written two questions about fitness for employment. The tool indexes the selected reports as one bundle and copies those questions. It does not complete Form 7.

Stop and hand it back when

  • The tool is asked to write the lodged application, or to invent a question the lawyer has not written.
  • The bundle is over 500 pages and rule 67C(2) has not been opened.

Checklist

  1. A claim must already have been submitted to the employer or the insurer. The worker may request an insurer review before lodging. The page states no time for that review, so none is counted.
  2. Liability and the amount of lump sum permanent impairment compensation, or past or future medical expenses, use an Application to Resolve a Dispute. Only the worker or their representative may apply where the dispute is about lump sum compensation for permanent impairment. The Commission may refer that application to a medical assessor.
  3. The degree of permanent impairment other than for a lump sum, whether that degree is fully ascertainable, or condition and fitness for employment, use an Application for Assessment by a Medical Assessor. The page calls that application Form 7 and the response Form 7A.
  4. Documents go in one bundle, indexed, sorted by category and paginated, with no duplicates. More than 500 pages may be introduced only if rule 67C(2) is met. That rule was not opened. Do not quote it.
  5. The page does not set out the medical questions. Section 327 limits a later appeal to its stated grounds and is not the list of questions for the application. The respondent has 21 days from registration to respond. That is not the worker's time to lodge.
