How AI is used
From the refusal and any claim decision, using a firm-controlled tool, mark a section 232P service-request refusal or a section 232R payment-request refusal as reviewable, and mark the page's particular-procedure example as non-reviewable. Do not decide that the treatment is payable.
What the lawyer must review
  • You decide whether the refusal can be reviewed, and in which forum.
  • Do not send the page's particular-procedure example to review. A section 232P or 232R refusal is reviewable.
  • A non-reviewable decision may be an Industrial Magistrate appeal. You choose that path.
  • Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach.

The work product

Forum. Forum for a Queensland treatment-funding refusal

Produce. A forum note: review, or the non-reviewable example. No decision that treatment is payable.

Have ready. The refusal; The date it was received; Any separate decision allowing or rejecting the claim.

Example of the limit. Illustrative example: The insurer has accepted the claim and later refuses one operation. The note marks that refusal as the page's example of a decision that is not reviewable. It is not a section 232P or 232R request. It does not say the operation must be funded.

Stop and hand it back when

  • The document is not a decision about funding or about the claim.
  • The output would decide that the treatment is payable.

The review page gives a decision not to fund a particular medical procedure as an example of a decision that is not reviewable, and says some non-reviewable decisions may be appealed to an Industrial Magistrate. Section 540(1) makes a refusal of a section 232P service request, or a section 232R payment request, reviewable. Those requests are in chapter 4A, not the page's example. Section 548(2) defines a non-reviewable decision as an insurer's decision under chapter 3 or 4 that section 540(1) does not list, other than a decision about additional lump sum compensation under section 193A. Section 548A(2)(c) makes an industrial magistrate the appeal body for a non-reviewable decision, and Form 67 is filed in the Magistrates Court. A decision to allow or reject a claim, or to terminate or suspend payment of compensation, is reviewable. Section 542 sets the review time.
