- Extract the injury date, what the client knew and when, the type of defendant, and the forum. Do not state the deadline or say a notice was given in time.
- What the lawyer must review
- Limitation is state law, with federal exceptions. Texas Civil Practice and Remedies Code § 16.003(a) requires suit for personal injury, and for forcible detainer, not later than two years after the day the cause of action accrues, except as §§ 16.010, 16.0031, and 16.0045 provide. Subsection (b) gives two years from death for a wrongful-death action. A health-care liability claim may sit in another chapter. You open it. A tort claim against the United States must be presented within two years and sued within six months of the mailed denial (28 U.S.C. § 2401(b)). You state the date.
