Checklist
- If the Personal Injuries Proceedings Act 2002 applies, the respondent's duty to give documents sits in that Act. This task does not replace the notice of claim, and the time limit for the notice was not opened.
- A notice of claim to an unincorporated institution is given to its head under Civil Liability Act s 33H(3).
- The November 2022 guidelines do not set out a records protocol. They do say the State will help identify the proper defendant, which is often what the records are for. The guidelines do not bind the State.
- The letter names institutions, people and years. It does not narrate the abuse.
