Ask an institution for its records of complaints, staff and care

Key facts

Human involvement
YellowClose supervision
How AI is used
From the institutions and years the lawyer has named, draft a request that asks for complaint files, personnel records of the person named, placement or enrolment records, and earlier claims, for those years only. Use the lawyer's list of documents, and do not add allegations or describe the abuse.
What the lawyer must review
  • The lawyer settles the letter before it is sent. It asks only for the categories the lawyer has approved.
  • Check privilege, other people's privacy, and whether a pre-court duty to produce already applies.
  • Do not describe the abuse in the letter.
  • Keep the file in the firm's system. Confidentiality, APP 11 and a notifiable-breach check apply.

Checklist

  1. The letter names institutions, people and years. It does not narrate the abuse.
  2. Do not ask for another child's records unless the lawyer has added that category.
  3. In Queensland, do not treat this letter as the notice of claim. If that Act applies, the notice is a separate step, addressed to the head where the institution is unincorporated.
  4. In New South Wales, where the recipient is a State agency, the lawyer has spoken with the client about principle 17 before any account is enclosed.
