Check a behaviour support plan against Queensland restrictive-practice approvals

Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the behaviour support plan and the authorisation record, list each practice and the approver named on the record. Do not decide that the practice is authorised.
- What the lawyer must review
- You decide whether each practice is containment, seclusion, restraint, or restricting access.
- Match each one to the Queensland approver. A behaviour support plan is not the approval.
- Respite and community access can have a different approver. Check which service is in the plan.
- Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach.

The work product

Produce. A list of practices and the approver recorded, with gaps marked.
Have ready. The behaviour support plan; The authorisation record; The service type.
Example of the limit. Illustrative example: The plan describes locking the front door at night in an accommodation service. The list records containment and that the file has no QCAT order. It does not say the practice is lawful.
Stop and hand it back when
- The service type is not identified.
- The question is whether the practice should be used, rather than who must approve it.

Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
Disability Services Act 2006 (Qld) s 144 defines a containment or seclusion approval as approval given by the tribunal under the Guardianship and Administration Act 2000, chapter 5B, part 2. It also defines a guardian for a restrictive practice matter and an informal decision-maker.
The QCAT page says generally only QCAT can approve containment and seclusion, with a respite guardian able to approve those practices only while the adult receives respite or community access. Mechanical, physical or chemical restraint in other settings is for a guardian for restrictive practice (general) appointed by QCAT. Restricting access may also be an informal decision-maker under s 144. The plan must accompany the practice. The page says only the Department of Child Safety, Seniors and Disability Services can apply for containment and seclusion in accommodation, jointly with a non-government provider if one is involved.
