The work product

Forum. Victoria. NDIS Worker Screening Check issued through the Victorian Worker Screening Unit.

Produce. A register of clearance number, issue and expiry, and the 90-day renewal window, with no decision that the worker may start.

Have ready. Clearance records; The provider's worker list; Any exclusion or interim exclusion notice.

Example of the limit. Illustrative example: A clearance notice is dated and has not been revoked. The register records a five-year expiry and a renewal window of 90 days before that date. It does not say the worker may start in a risk-assessed role.

Stop and hand it back when

  • The clearance record has no expiry date.
  • An exclusion notice is in the file and has been entered as a current clearance.

Checklist

  1. Record a clearance as valid for 5 years from the date of the notice unless the record shows it was surrendered or revoked. Count the renewal window as 90 days before that expiry.
  2. Victoria's page says a person must not work in a risk-assessed role for a registered provider while a first check is being decided, unless an exception on that page applies. Do not enter a pending first application as current.
  3. A clearance that has expired may still allow work only where the page's renewal conditions are all met, including that there is no interim exclusion. The lawyer checks those conditions. The register does not.
  4. An exclusion means the person cannot work in a risk-assessed role. The page says a further application cannot be made for five years after the notice unless circumstances change, and work is still not permitted until a clearance is received.

Sources

If an internal review upholds an exclusion, the page says an application to the Victorian Civil and Administrative Tribunal may be made within 28 days after that internal review. Record that date only when the file shows it. Do not calculate it from a missing date.

The Worker Screening Act 2020 is in force as version 018, effective 19 October 2026. The page's offence table cites section 118(1). The text of that section was not opened. The page's dollar table for penalty units is labelled 2024-2025. Do not treat those dollars as the current unit.
