Record whether the file describes the ship as seagoing, and whether a refuse record book, a shipboard management plan, or an Annex V placard is in the file. Write no oil-record entry and no discharge conclusion.
What the lawyer must review
33 USC section 1903(a) gives the Secretary the duty to administer and enforce the MARPOL Protocol, Annex IV to the Antarctic Protocol, and the chapter, unless the chapter specifies otherwise. In that administration, Annexes I and II apply only to seagoing ships. Subsection (b) gives the Administrator, and no other person, authority to issue Engine International Air Pollution Prevention certificates for a vessel of the United States as defined in 46 USC section 116, which was not opened, and authority to administer regulations 12 through 19 of Annex VI. Enforcement of Annex VI is only as specified in section 1907(f), which was not opened. Subsection (c)(4) requires the Secretary of the department in which the Coast Guard is operating to prescribe regulations that require certain ships described in section 1902(a)(1) to maintain refuse record books and shipboard management plans, and to display placards notifying the crew and passengers of Annex V and of Annex IV to the Antarctic Protocol. Section 1902 was not opened. Section 1903 does not state an oil-record-book duty and does not state a discharge prohibition.
