Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- List the bill of lading number, the delivery date in the papers, whether the papers say the damage was apparent, and the date any notice was already sent. Write no sentence of a notice or protest.
- What the lawyer must review
- The Carriage of Goods by Sea Act note to 46 USC section 30701 requires written notice of loss or damage, and its general nature, to the carrier or agent at the port of discharge before or at removal of the goods. If the loss or damage is not apparent, the notice must be given within three days of delivery. Removal without that notice is prima facie evidence of delivery as described in the bill. Failure to give notice does not bar suit. The carrier and the ship are discharged unless suit is brought within one year after delivery or the date the goods should have been delivered. The Act does not apply to charter parties. You write any notice. The tool writes none of it.
