Decide whether to give or accept an indemnity for delivery without the original bill

- How AI is used
- From the bill and the indemnity, mark whether the request is delivery without surrender of the negotiable bill, delivery at a different port, or both, and list each departure from wording the lawyer has already marked. Do not draft or amend the indemnity.
- What the lawyer must review
- 49 USC section 80102 applies this chapter to a bill of lading a common carrier issues for the movements it lists, including from a place in a State to a place in a foreign country. Section 80110 requires delivery, on demand, to the consignee named in a nonnegotiable bill or the holder of a negotiable bill when that person has the bill and, for a negotiable bill, offers to indorse and give it to the carrier. Section 80111(c) makes the carrier liable, including to a later good-faith purchaser of the bill, if it delivers goods covered by a negotiable bill without taking and canceling the bill. No section opened here authorises delivery against an indemnity in place of the bill. You decide whether to give or accept any indemnity and you write any wording. ABA Formal Opinion 512 requires you to supervise this output.
