How AI is used
From the charter clause, the logs, the noon reports and the statement of facts, list the period deducted, the event relied on, and whether that event is one the clause names. Do not calculate a hire figure to be deducted.
What the lawyer must review
Off-hire is the charter clause. The Carriage of Goods by Sea Act, in the statutory note to 46 USC section 30701, says the Act shall not be applicable to charter parties. If bills of lading are issued for a ship under a charter party, they shall comply with the Act. A bill issued under a charter party regulates the relations between the carrier and a holder only from the moment it does so. District courts have original jurisdiction of any civil case of admiralty or maritime jurisdiction under 28 USC section 1333, saving to suitors other remedies. No federal off-hire statute was opened. You decide whether the clause operated, whether the charterer has proved loss of time, and whether the owner has a withdrawal or a counterclaim.
