How AI is used
From the list of books and the request, index each book that relates to property of the estate and each other place the records are said to be. Note the petition date and whether the schedules and the statement of financial affairs are on the file. Do not complete the schedules.
What the lawyer must review
You decide what must still be filed, and you complete the schedules. Federal Rule of Bankruptcy Procedure 1007(b)(1) says that, except in a Chapter 9 case or when the court orders otherwise, the debtor must file, on the appropriate Official Form if any, schedules of assets and liabilities, a schedule of current income and expenditures, a schedule of executory contracts and unexpired leases, a statement of financial affairs, copies of payment advices or other evidence of payment received from any employer within 60 days before the petition with all but the last four digits of the social-security number or individual taxpayer-identification number deleted, and a record of any interest in an account or program of the type specified in section 521(c). Rule 1007(c)(1) says that, unless subdivision (d), (e), (f), or (h) provides otherwise, the debtor in a voluntary case must file the documents required by (b)(1), (b)(4), (b)(5), and (b)(6) with the petition or within 14 days after it is filed. In an involuntary case, Rule 1007(c)(2) requires the (b)(1) documents within 14 days after the order for relief. 11 U.S.C. § 521(a)(4) says that if a trustee is serving, or an auditor is serving under 28 U.S.C. § 586(f), the debtor shall surrender to the trustee all property of the estate and any recorded information, including books, documents, records, and papers, relating to property of the estate. Section 521(i) says that, subject to paragraphs (2) and (4) and notwithstanding section 707(a), if an individual debtor in a voluntary case under chapter 7 or 13 fails to file all of the information required under subsection (a)(1) within 45 days after the petition, the case shall be automatically dismissed effective on the 46th day. That dismissal is not a general rule for every debtor or every chapter.
