How AI is used
Index the bank statements, aged payables, and board minutes in the file by date, and list which of those dates fall in the 90 days before the petition date stated in the file. Do not write an opinion or a court paper.
What the lawyer must review
The lawyer conducts the review. 11 U.S.C. § 547(f) is a presumption of insolvency for the 90 days before the petition, for preference purposes. Section 548(a)(1) is the two-year fraudulent-transfer reach. If the question is an involuntary petition, § 303(h) asks whether the debtor is generally not paying debts as they become due, absent a bona fide dispute, or whether a custodian of the kind described in § 303(h)(2) was appointed or took possession within 120 days before the petition. Bankruptcy Rule 9011(b) applies if any of this is put in a court paper. The tool writes none of that paper. Formal Opinion 512 keeps the records in a confidential tool.
