How AI is used
List whether the file contains the marriage certificate, evidence that any prior marriage ended, the bona fides documents the page describes, and Form I-130A. Write no petition and no narrative.
What the lawyer must review
The USCIS Form I-130 page says submitting the Petition for Alien Relative is the first step to help an eligible relative apply to immigrate and apply for a Green Card, and that filing or approval does not give any immigration status or benefit. For a spouse, the page asks for a copy of the marriage certificate and evidence that any prior marriage was terminated. Bona fides examples on the page are joint ownership of property, a lease showing joint tenancy of a common residence, combined financial resources, birth certificates of children born to the couple, third-party statements, and other documentation of an ongoing marital union. The page calls those third-party statements affidavits and requires the person's full name and address, date and place of birth, and how the person knows the marriage. The tool does not draft them. A spouse petition also requires Form I-130A. A separate Form I-130 is filed for each eligible relative unless the relative is a derivative. Unsigned forms are rejected. A form is rejected if it lacks Part 1 relationship, or Part 2 petitioner full name, date of birth, mailing address, or marital information, or Part 4 beneficiary full name, date of birth, physical address, or marital information. The petitioner selects only one of Part 4 Question 61 or Question 62. A foreign-language document needs a full English translation and a certification that the translation is complete and accurate and that the translator is competent. Originals are not sent unless the instructions or regulations request them. An alert on the page says the filing location changed on 7 October 2026, with a grace period for forms postmarked on or before 9 November 2026. The tool does not choose an address and does not write the petition. This is not a partner-visa submission under the Migration Regulations.
