Turn a request for evidence or a notice of intent to deny into a checklist
Key facts

- YellowClose supervision
- How AI is used
- Copy each item the notice asks for and the deadline printed on the notice. Do not calculate a different deadline and do not draft the response.
- What the lawyer must review
- USCIS Policy Manual Volume 1, Part E, Chapter 6 says the maximum response time for a request for evidence is 12 weeks, which it also states as 84 days, and that regulations prohibit officers from granting additional time. When the request is mailed, 3 days are added, which the same chapter describes as a maximum of 87 days after mailing for receipt of a timely response. If the last day falls on a Saturday, Sunday or federal holiday, the period runs to the next day that is not one of those. A notice of intent to deny has a maximum response time of 30 days. The chapter also says a response must establish eligibility at the time of filing, and that a request is not issued to cure a filing that was ineligible then. You use the date printed on the notice. You write the response.
