How AI is used
From the passage the lawyer has marked and the amendment the lawyer has settled, draft a request that asks the holder to amend the health information or, if it will not, to attach the statement of the amendment sought so it can be read with the information. Do not state a number of days. Do not assert that the record is wrong.
What the lawyer must review
  • The lawyer settles the words. The draft asks for an amendment or for the statement to be attached.
  • Principle 8 states no number of days. Do not copy a 30-day correction period.
  • Keep health and wage records in a firm-controlled tool, not a public one.
  • ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth).

Checklist

  1. Ask for corrections, deletions or additions so the information is accurate and, having regard to the purpose of collection or use and any directly related purpose, relevant, up to date, complete and not misleading.
  2. If the draft assumes the holder will not amend, ask it to take reasonable steps to attach the statement so it can be read with the information.
  3. If the information is amended, the individual is entitled, if reasonably practicable, to have recipients notified.
  4. State no number of days. Principle 8(4) says compliance is not required where the holder is lawfully authorised or required not to comply, or where another law permits non-compliance, including the State Records Act 1998.
