How AI is used
List the evaluation factors stated in the solicitation and the report or analysis the contracting officer identifies for each factor. Do not score, rank, or compare the proposals, and do not write the rationale for the source-selection decision.
What the lawyer must review
FAR 15.308 provides that the source selection authority's decision shall be based on a comparative assessment of proposals against all source selection criteria in the solicitation. The source selection authority may use reports and analyses prepared by others, but the decision shall represent that official's independent judgment. The decision shall be documented, and the documentation shall include the rationale for any business judgments and tradeoffs made or relied on, including benefits associated with additional costs. Although the rationale must be documented, the documentation need not quantify the tradeoffs that led to the decision. FAR 15.304 requires the solicitation to state the evaluation factors and significant subfactors. The source selection authority, not the tool, makes and documents the decision.
