Identify which FAR text applies to a solicitation
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the solicitation issue date the lawyer identifies, record the FAR change effective date shown on the acquisition.gov text being used, and whether that solicitation was issued on or after that date. Do not rewrite clauses and do not decide that an earlier solicitation should be amended.
- What the lawyer must review
- The lawyer confirms the date is the solicitation issue date, not the award date and not a later modification. FAR 1.108(d) says that, unless otherwise specified, a FAR change applies to solicitations issued on or after its effective date. A contracting officer may include the change in a solicitation issued before that date only if award occurs on or after the effective date, and may include it in an existing contract only with appropriate consideration. The acquisition.gov text opened on 22 October 2026 is FAC 2026-01, effective 13 March 2026. The lawyer checks the version named in the solicitation before any clause is treated as the text in force.
