How AI is used
From the document, record who asked for it, whether a law-enforcement officer asserted the grounds, and whether the protected person has filed a request in court. Do not decide that the document is itself a long-term order.
What the lawyer must review
The lawyer decides what the document is. California Family Code section 6250 allows a judicial officer to issue an ex parte emergency protective order when a law-enforcement officer asserts reasonable grounds to believe a person is in immediate and present danger of domestic violence, based on that person's allegation of a recent incident or threat of abuse, or one of the child, abduction, or elder grounds the section states. No emergency protective order shall be issued based solely on an allegation of financial abuse of an elder or dependent adult. The Judicial Branch guide describes a different path: the protected person files court forms, a judge decides quickly whether to grant a temporary restraining order, and a later court date decides a long-term order. A criminal protective order, if one already exists, does not stop a person from asking for a domestic-violence restraining order. The lawyer uses the document in hand, not the label someone has written on the file.
