- How AI is used
- List the mandatory Judicial Council forms named on the court self-help page for this application, and a checklist of facts still missing. Write none of the factual account.
- What the lawyer must review
- California Family Code section 6300 allows an order to restrain a person if an affidavit or testimony, and any additional information under section 6306, shows reasonable proof of a past act or acts of abuse. The court may issue the order based solely on the affidavit or testimony of the person requesting it. An ex parte order shall not be denied solely because the other party had no notice. The clerk shall not reject an ex parte request for filing if it is on the mandatory Judicial Council forms, includes the forms required to issue an order, and identifies the parties. The Judicial Council self-help page is the current guide to asking for the order and to the forms. You complete the forms with the client. The factual account is the separate task and is not written by the tool. Other states use their own forms. Opinion 512 and Model Rule 1.6.
