Record the property and animal conditions a protective order may include
Key facts

- YellowClose supervision
- How AI is used
- From the instructions and the draft order, list any condition about personal property, exclusive possession of an animal, or a move-out. Do not decide which conditions to ask for.
- What the lawyer must review
- The lawyer decides which conditions to ask for and writes them. California Family Code section 6320(a) says the court may issue an ex parte order enjoining a party from, among other conduct, destroying personal property, and from contacting, coming within a specified distance of, or disturbing the peace of the other party. On a showing of good cause, the order may also protect named family or household members. Section 6320(b) says that, on a showing of good cause, the court may grant the petitioner exclusive care, possession, or control of an animal owned, possessed, leased, kept, or held by either party or by a minor child in either household, order the respondent to stay away from the animal, and forbid the respondent from taking, transferring, encumbering, concealing, harming, or otherwise disposing of the animal. The Judicial Branch guide says a domestic-violence restraining order can protect property and pets and can order a move-out from a home shared with the protected person. The opened section does not set a procedure for a third party to hand property back.
