Identify the person most in need of protection in a cross-application
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- Organise the two applications into a side-by-side table: each allegation, its date, the party alleging it, and the document relied on, with the competing accounts of the same incident set against each other. The tool does not assess, characterise or advise.
- What the lawyer must review
- The lawyer decides who is the person most in need of protection, whether conduct is coercive or resistive, and whether to press, consent or withdraw — and records the reasons for that conclusion.

Who does what
| Role | What they do |
|---|---|
| Assistance | Supporting preparation only. Organise the two applications into a side-by-side table: each allegation, its date, the party alleging it, and the document relied on, with the competing accounts of the same incident set against each other. The tool does not assess, characterise or advise. The tool writes nothing into the document. Substantive advice, judgement and any restricted content remain with the responsible human. |
| Lawyer | Perform the substantive analysis and decisions. Independently check any permitted supporting work and approve the exact output for its intended use. |
Checklist
- Read both applications in full and identify the pattern and the context rather than counting incidents; the party with more allegations is frequently not the party in need of protection.
- Identify conduct that is resistive or protective rather than coercive — leaving with the children, taking a phone, calling police, returning for belongings — and do not treat it as equivalent to the conduct alleged against the other party.
- Check the statutory test in this jurisdiction, whether the court must identify a single person most in need of protection, and what the police view of the primary victim is, before the return date.
- Check whether orders against both parties are available at all in this scheme, and whether the right outcome is a single order with conditions on one party.
- Record the advice and the instruction; where the file shows the client is the person in need of protection, do not consent to an order against them to resolve the matter quickly.
