Build the contravention analysis from the police brief and the served order

Key facts

Human involvement
YellowClose supervision
How AI is used
Set each act alleged in the police brief against the exact words of the condition said to be contravened and against the service or notification record, and draft an internal table showing condition, act, evidence and gap. The lawyer decides whether each element is made out.
What the lawyer must review
The lawyer confirms the condition's wording from the sealed order in force on the date, confirms service or notification, and decides whether each element is made out and what the plea will be.

Checklist

  1. Take the condition's wording from the sealed order that was in force on the date of the alleged act, not from the application, a later order or the police fact sheet.
  2. Confirm the respondent had been served or otherwise properly notified before the alleged act; an order made in another jurisdiction is enforceable only once the respondent is notified under the law of the jurisdiction that made it.
  3. Check whether the conduct alleged falls inside the condition as worded, and check the common exceptions — contact initiated by the protected person, contact permitted by the order, contact through a lawyer, and contact required by a parenting order or a court-ordered arrangement.
  4. Check whether the same conduct is also charged as a separate offence and whether the charges overlap or are duplicitous on the facts alleged.
  5. Check whether this scheme prescribes a minimum or presumptive penalty for a contravention involving violence, and whether a prior conviction lifts the maximum, before any plea advice is given.
