How AI is used
List the restraints the draft order already contains beside the conduct described in Family Code section 6320. Write no advice and no consent term.
What the lawyer must review
Family Code section 6320(a) allows an ex parte order enjoining a party from molesting, attacking, striking, stalking, threatening, sexually assaulting, battering, impersonation of the kinds the section names, harassing, telephoning, destroying personal property, contacting directly or indirectly, coming within a specified distance, or disturbing the peace of the other party, and, on good cause, of other named family or household members. Disturbing the peace, in subdivision (c), means conduct that destroys the mental or emotional calm of the other party, including coercive control. An animal restraint under subdivision (b) requires good cause. The section does not provide a form of consent that admits nothing. You advise on whether to agree. The evidence that supports an order is dealt with separately under section 6300 and is not written here.
