Prepare a demand for a debt that is not a pleading
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- List the creditor, the balance, and the dates the lawyer has written down. Do not write the demand.
- What the lawyer must review
- You write the demand. There is no companies-act statutory demand in the sources opened, so do not call the letter one and do not state a deadline for winding up. If a debt collector sends it to collect a consumer debt, § 1692a identifies the debt collector and § 1692g is the validation rule. Section 1692g(d) says a formal pleading is not an initial communication. This letter is not that pleading. Section 1006.26(b) prohibits a debt collector from bringing or threatening a legal action on a time-barred debt. Model Rule 1.4(b) requires an explanation to your client before the letter goes. You decide whether the debt is time-barred under the state law that governs.
