Check a guarantee before a demand for payment
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the guarantee, quote the guarantor, the limit, any expiry, and any clause about notice or a waiver. Do not write a demand.
- What the lawyer must review
- You decide whether a demand is sent and what it says. No suretyship statute was opened, so the check does not say the guarantee is enforceable. Model Rule 1.4(b) requires you to explain the limit and the waiver to the client who is relying on it. If a debt collector will send the demand on a consumer debt, read § 1692a and § 1692g first. Section 1692g(d) takes a formal pleading, not a demand letter, outside the initial-communication rule. Formal Opinion 512 applies if the guarantee is put into a tool.
