Check a consumer collection letter against the validation statute and the time-barred-debt rule
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Mark the draft letter against the five § 1692g(a) statements and against whether it threatens a lawsuit. Quote the sentence. Do not rewrite the letter.
- What the lawyer must review
- Use this check only if 15 U.S.C. § 1692a(6) makes the sender a debt collector and the debt is a consumer debt. Section 1692g(b) says collection in the thirty-day period must not overshadow the dispute right. Regulation F § 1006.26(b) prohibits a debt collector from bringing or threatening a legal action on a time-barred debt, defined as a debt whose applicable statute of limitations has expired. The prohibition does not apply to a proof of claim in a bankruptcy case. You decide whether the letter threatens suit and whether the limitation period has expired under the state law that governs.
